Terms of Use

These Terms of Use ("Terms") are an agreement between you and CARHAIX AU PTY LTD ("Hound", "we", "us" or "our") and govern your use of the Hound mobile application, websites and related services (the "Services"). By using the Services, you agree to these Terms.

1. Eligibility and accounts

You must be at least 13 years old and legally able to enter into these Terms. You must provide accurate account information, keep your sign-in details secure and notify us promptly of suspected unauthorised access. You are responsible for activity through your account.

2. The Services

Hound helps users discover places, events and offers and create or share plans. Information may come from users, venues and third-party sources. Availability, opening hours, pricing, offers and event details can change, so you should confirm important information directly with the relevant venue or organiser.

3. Acceptable use

You must not misuse the Services, break the law, infringe another person's rights, submit harmful or deceptive content, attempt unauthorised access, interfere with service operation, scrape or copy the Services through automated means without permission, or use the Services to distribute malware or spam.

4. Your content

You retain ownership of content you submit. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify, display and distribute that content only as reasonably necessary to operate, improve and provide the Services. You confirm that you have the rights needed to submit your content.

5. Our content and intellectual property

The Services, including our software, branding, designs and content, are owned by us or our licensors and protected by law. Except for the limited right to use the Services under these Terms, no rights are transferred to you.

6. Third-party services

The Services may contain links to or integrations with third-party services. We do not control and are not responsible for those services, their content or their practices. Separate terms may apply to your use of them.

7. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access where reasonably necessary to protect the Services or others, respond to legal requirements, or address a serious or repeated breach of these Terms. Provisions that by their nature should survive termination will continue to apply.

8. Disclaimers

To the extent permitted by law, the Services are provided "as is" and "as available". We do not guarantee that recommendations or third-party information will be complete, current or suitable for you, or that the Services will always be uninterrupted or error-free. Nothing in these Terms excludes rights or guarantees that cannot lawfully be excluded, including under the Australian Consumer Law.

9. Liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of data, profits or opportunity, or loss arising from third-party venues, events, offers, content or services. Where liability cannot be excluded, it is limited to the maximum extent permitted by law.

10. Changes

We may change the Services or these Terms. We will publish updated Terms here and revise the date above. If a material change requires notice or consent, we will provide it as required by law. Continuing to use the Services after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and Hound submit to the courts of New South Wales and courts entitled to hear appeals from them.
